Investment Fraudster Gets 41 Months

GARY RAYMOND MOSS, 67, of El Paso, Texas, was recently sentenced to 41 months in prison after pleading guilty to one count each of mail fraud and securities fraud.

In addition to the prison term, U.S. District Judge Frank Montalvo ordered that Moss pay $340,600 in restitution and be placed under supervised released for three years after completing his prison term.

Moss solicited investors from across the country and guaranteed a 25-50 percent monthly return on a “limited deposit program.” He produced false monthly statements or in most cases, never provided investors with any statements. The investors attempted to get their money back, as their contract stated they could, but were unable to get the money.

The case was investigated by the El Paso Division of the FBI, The Texas State Securities Board and prosecuted by Assistant U.S. Attorney Donna Miller.
